애플의 SiRi특허

SiRi는 인간과 기계 사이의 인터페이스 혁신을 가져온 것으로 평가되고 있다.

이제는 전화기와 인생이나 철학을 논하고, 농담하고 장난도 치며, 논쟁을 벌이는 그런 시대가 온 것이다.  참고기사 

 

 

이러한 SiRi에 관련하여 애플은 지난 연말에 하나의 특허는 지난 2012. 6. 29 일자 캘리포니아 북부지원에서의 갤럭시 넥서스에 대한 가처분 결정에 기초가 된 4가지 특허중 하나에 포함되어 있다.

이 특허의 클레임은 총 21항.
독립항은 방법(제1항), 장치(제6항) 및 저장매체(제11항)에 대해 각 하나씩.

방법과 장치 클레임에 대해서만 번역해본다.

US8,086,604호 "Universal interface for retrieval of information in a computer system"

1. A method for locating information in a network using a computer, comprising: 

- receiving by the computer an inputted information descriptor from a user-input device; 

- providing said information descriptor received from the user-input device to a plurality of heuristic modules, 

-- wherein: each heuristic module corresponds to a respective area of search and employs a different, predetermined heuristic algorithm corresponding to said respective area to search the area for information that corresponds to the received information descriptor, and the search areas include storage media accessible by the computer; 

- searching by the heuristic modules, based on the received information descriptor, the respective areas of search using the predetermined heuristic algorithms corresponding to each respective area of search; 

- providing at least one candidate item of information located by the heuristic modules as a result of said searching; and 

- displaying by the computer a representation of said candidate item of information on a display device. 

1. 컴퓨터를 이용하여 네트워크 내 정보를 추출하는 방법에 있어서,

- 사용자 입력장치로부터의 입력 정보 서술자(descriptor)를 컴퓨터가 수령하는 단계,

- 상기 입력장치로부터 수령한 상기 정보 서술자를 복수의 학습(heuristic) 모듈에 제공하는 단계,

-- 각 휴리스틱 모듈은 각 검색영역에 대응하고, 해당 검색영역 마다 각기 상이한 소정의 학습 알고르즘을 채용하여, 해당 영역에서 상기 수령한 정보 서술자에 대응하는 정보를 검색하며, 

-- 상기 검색영역들은 상기 컴퓨터가 접근가능한 저장매체를 포함.

- 상기 학습 모듈로, 상기 수령한 정보 서술자에 기초하여, 상기 각 검색영역에 대응하는 소정의 학습 알고리즘을 이용해서 상기 각 검색영역을 검색하는 단계,

- 상기 학습모듈에 의해 추출된 적어도 하나의 후보 정보 아이템을 검색결과물로서 제공하는 단계, 및

- 상기 컴퓨터에 의해 상기 후보 정보 아이템을 디스플레이 장치에 표시하는 단계.

= 종속항2~5항은 후보 정보 아이팀들의 순위결정에 관해 한정.

= '검색영역'은 컴퓨터 내 어플, 데어터 파일, 웹 등이 될 수 있음.

6. An apparatus for locating information in a network, comprising: 

- an interface module configured to receive an inputted information descriptor from a user-input device; 

- a plurality of heuristic modules configured to search for information that corresponds to the received information descriptor, 

-- wherein: each heuristic module corresponds to a respective area of search and employs a different, predetermined heuristic algorithm corresponding to said respective area, and the search areas include storage media accessible by the apparatus; and 

- a display module configured to display one or more candidate items of information located by the plurality of heuristic modules on a display device.

6. 네트워크 내 정보를 추출하는 장치에 있어서,

- 인터페이스 모듈 : 사용자 입력장치로부터의 입력 정보 서술자를 수령하도록 구성,

- 복수의 학습모듈 : 상기 수령 정보 서술자에 대응하는 정보를 검색. 각 학습모듈은 각 검색영역에 대응하고, 각 검색영역에는 각기 상이한 소정의 학습 알고리즘이 채용되며, 검색영역들은 장치의 점근이 가능한 저방매체를 포함.

- 디스플레이모듈 : 상기 복수의 학습모듈에 의해 추출된 하나 이상의 후보 정보 아이템을 디스플레이 장치에 표시.

이 발명의 요지를 간단히 정리하면, 사용자의 입력이 있으면 복수의 상이한 알고리즘이 여러 개의 검색영역(어플, 파일, 웹 등)을 각각 검색한 다음 그 검색결과를 보여준다는 것이다.

한마디로 복수의 검ㄱ색영역에 대해 통합적으로 검색을 한다는 것이 핵심 요지.

클레임은 군더더기 없이 이 요지를 그대로 청구하고 있다.

'학습모듈'이라는 용어가 다소 제한적인 의미를 주지 않을까 생각할 수 있지만, '검색' 이상의 다른 기능을 한정하고 있지 않으므로 권리의 해석에 부정적인 영향은 없는 것으로 보인다.

이 특허는 발명의 개념도 명료하고 청구범위의 작성도 비교적 깔끔하다.

오랫만에 보는 매우 잘 작성된 특허명세서인 것으로 평가된다.

이 특허의 유효성에 대해서는 캘리포니아 북부지원이 6월29일자 가처분 결정을 통해 어느 정도 검증되었다. 

안드로이드 즉 구글과 삼성의 앞길에 이 특허는 엄청난 장벽으로서 기능할 것이다. 

특히 음성 검색 기능을 강화하겠다고 장담한 구글은 검색 분야에서만 해도 큰 타격을 입을 것으로 예상된다.
